This assignment consists of two parts. The first part consists of the third installment for the research paper and is worth 20 points out of the 200 points allotted for this assignment. The second part requires application of concepts learned in Weeks 1–3and is worth significantly more than previous assignments and more than the first part of the assignment.

Part I—Research Paper

This week, you will research laws or regulations related to the topic you selected. The information may require research of federal and/or state laws, as well as administrative agency laws. Compare the laws of two states, if applicable. For example, if you are writing about gender discrimination, compare the federal law with law from one of the states that also provides protection at the state level. State laws often provide more protection than the federal law. Summarize the information about the laws or regulations you found related to your topic.

Part II—Legal and Ethical Challenges in Business Organizations

Read the scenarios and the questions that follow. Identify the legal issue(s) and apply legal concepts and possible arguments for each question. After reading the scenarios, prepare a resolution for each question using laws, cases, examples, and/or other relevant materials. Consider using short headings (consult APA materials) to separate the topics. Summarize the facts; do not copy the scenarios into the paper. Overview

Famous Subs and Pizza Company (FSPC) is a publicly traded corporation headquartered in Tallahassee, Florida, operating restaurants in ten states. The company also owns a food processing and distribution facility in Jackson, Mississippi. Approximately 20% of the employees work full time; however, FSPC primarily hires part-time employees as delivery drivers, cooks, and sandwich makers. FSPC leases space for most of its restaurants in shopping centers, but the company owns a few of the properties, as well as its headquarters office and the distribution facility. The company has experienced explosive growth over the last three years, but the growth has been accompanied by an increase in legal issues. The CEO, Chip Stone, seeks your advice on the following legal and ethical issues.

S1: Jurisdiction, Torts, and Agency(Ethics and law for managers)

Faye Kennett, 4’5″ tall, visited an FSPC outlet in Birmingham, Alabama. She was four months pregnant and craved a pizza with anchovies. She took the receipt after ordering her food and was reading it while walking to a table. She noticed that the words “Fat Midget” were printed on the receipt. Before she could get to her table, Faye stepped in some water, slipped, and fell, sustaining injuries to her back and left leg. She suffered a miscarriage forty-eight hours after falling at FSPC. Kennett filed a negligence suit in an Alabama state court against FSPC, the store manager, and the employee at the register who had printed the receipt.

  • Explain whether the Alabama state court is the proper court for the lawsuit. Determine whether Kennett could have filed the lawsuit in Florida.
  • Provide arguments for Kennett, FSPC, the manager, and the employee at the register. Determine which party should win and provide support for your selection.

S2: Contracts, Agency, and Torts(Ethics and law for managers)

FSPC hired Pete Zahutt as a delivery driver for one of its stores in Jackson, Mississippi. After five years, FSPC promoted Pete to District Manager and let him drive the company car that was wrapped with the company logo. Once or twice a week, Pete also picked up supplies at the warehouse on his way to work. With his boss’s knowledge, Pete also used the FSPC car during working hours to run some personal errands, like pick up his daughter after school. The company viewed the arrangement as an opportunity for free advertising. One Friday night, after Pete left work in the company car, he delivered two pizzas to some friends, who invited Pete in for a beer. Pete ate some pizza with his friends, drank a few beers, and left for home. On the way home, Pete was texting his girlfriend and hit another car, severely injuring himself and the driver of the other car, Al K. Seltzer. Seltzer sued Pete and FSPC; however, FSPC’s insurance company refused to cover Pete or to defend or indemnify him in the lawsuit. Pete then sued the insurance company and FSPC. The insurance company argued that Pete was not an “insured” under its policy with FSPC because he did not have permission to use the company car when the accident occurred.

The insurance policy defines an insured as “[a]nyone else while using with your permission a covered auto you own, hire, or borrow . . .”

“Permission” is “consent to use the vehicle at the time and place in question and in a manner authorized by the owner, either express or implied.”

  • Did Pete have implied permission to use the car?
  • Ignoring the issue of insurance, is FSPC (and, therefore, the insurance company) liable for the injuries sustained by Seltzer under respondeat superior? If so, on what basis?

S3: ADR, Contracts, and Employment(Ethics and law for managers)

FSPC requires its employees to sign a confidentiality and noncompete agreement. The confidentiality portion explains that employees will be given access to critical information related to recipes, suppliers, and other similar data during their employment. Employees must agree that the information is a valuable asset and that they will not disclose the information during or after their employment. Employees must also agree to not make copies of any such information. The noncompete portion of the agreement states that during employment and for a period of two years after termination for any reason, an individual will not work for any business that derives more than 10% of its revenue from selling sub or pizza products and is located within 3 miles of any FSPC facility. Finally, the agreement provides that any dispute arising from the confidentiality and noncompete agreement shall be resolved exclusively through arbitration.

While attending college in Tampa, Florida, Dee Liver worked as a delivery driver for FSPC from June 2012 until May 2014.

Dee signed a document titled “Acknowledgment of Receipt of Employee Handbook,” which states that the handbook contains important information about the employer’s general personnel policies and Dee’s privileges and obligations as an employee. The document also states, “I understand that I am governed by the content of the Handbook and that [Employer] may change, rescind, or add to any policies, benefits, or practices described in the Handbook from time to time in its sole and absolute discretion, with or without prior notice.” Dee was not presented with the confidentiality and noncompete document until January 2014. FSPC stated that she must sign the document as part of her continued employment with the company.

Dee resigned from FSPC when she moved to Gainesville Florida to start pharmacy school. In September 2014, Dee applied for a job and was hired as a delivery driver at Papa John’s Pizza. FSPC filed a lawsuit against Dee for a breach of contract. Dee filed to dismiss the case because the agreement stated that disputes must be resolved through arbitration.

  • Provide arguments for Dee and FSPC related to the arbitration clause. Determine which party will win and provide a reference to a case or other scholarly support for your answer.

S4: Administrative Agencies and Consumer Protection

FSPC operates a food processing plant in Mississippi, where various meat products are packaged for shipment to restaurants. After FSPC customers in Tennessee, Alabama, and Louisiana complained of becoming sick after eating roast beef subs, it was determined that the meat was contaminated with Escherichia coli, a bacteria responsible for causing food poisoning. Additional inspections immediately following the outbreak of E.coli in May 2015 revealed that the restaurants did not provide the required nutritional information for products on their menu.

  • Which government agency is responsible for protecting the public in the E. colicase? Explain the responsibilities of the agency.

S5: Intellectual Property(Ethics and law for managers)

Pepe Roni was a part-time pizza maker at FSPC and a full-time information technology major at the South University in Tampa. As part of his final project in the capstone class, Pepe developed a computer program that created the fastest and most economical routes for delivery drivers. The program also tracked the locations of drivers. Pepe called the program Deliver Fast. The program was designed to be used by any food delivery service. FSPC believes it owns the invention since Pepe was employed by the company when he developed the program. Pepe believes he owns the rights to the invention since it was created for a school project and could be used for any food delivery company.

  • Provide arguments for FSPC and Pepe regarding ownership of the invention, Deliver Fast. Determine which party should win and provide support for your answer.

S6: Employment and the Constitution

Cal Kulate worked in the accounting department at the FSPC headquarters in Florida. He started out as a cashier in one of the stores, was promoted to store manager, and was eventually promoted to the accounting department at headquarters in Florida. Cal received numerous outstanding-job evaluations over the years with the company. Cal and his partner, Jim, married recently. Jim now received medical, dental, and other benefits as part of Cal’s employment package with FSPC.

Cal reported to the director of accounting, Faith Christianson. Cal did not receive a raise for the first time in ten years, after receiving an unflattering performance review from Faith. Other employees heard Faith say, “Same-sex marriages are wrong. The Bible states that marriage should be between a man and a woman.” Faith posted Bible verses in the breakroom and at the bottom of her e-mails. Cal reported Faith’s behavior to Human Resources, but her behavior only worsened after the report.

Cal posted some comments about Faith’s behavior on his Facebook page. He asked if other employees had experienced any discriminatory actions by Faith or other managers. Cal commented that the company did not discipline Faith after he reported her behavior; therefore, he believed the company supported sexual orientation discrimination. Cal also posted an unflattering caricature of Faith on his Facebook page. One commenter suggested that Cal report the company to the EEOC. After another employee showed the posts to Faith, she demanded that Cal remove the posts. When Cal refused, he was terminated.

One of the employees who worked for Cal, Cybil Wrights, reported Faith’s treatment of Cal to the EEOC. Cybil was an at-will employee who had been with FSPC for two years. In response to the EEOC report, Faith terminated Cybil.

Do not provide generic resolutions, such as “the company should provide training and implement procedures to avoid future problems.”

Scenario: Hanna

Hanna is in treatment at your mental health center for Acute Stress Disorder. She tells you that recently, she is unable to think clearly at night because she begins to feel anxious that her oldest son will not return safely from his military deployment. She adds that her boss has given her two extra shifts a week at her call center job. It is overwhelming during those shifts the client reports because they are the heaviest call times. Client stated that she is in line for a promotion, so does not want to refuse the shifts. Client then reported that she has not been eating or sleeping well because she has to drink wine to get to sleep at night. Client stated that she thinks that she needs to drink to get to sleep now. When asked about her children, client stated that she and her husband have custody of them, but her youngest daughter is causing a lot of trouble in school. The primary goal of this literature review is to integrate concepts from four different content domains within the larger field of psychology. The four content domains should be chosen from previous coursework in this program. In this paper, students will review the findings in the individual empirical articles, organize the research in a meaningful way, evaluate the reliability, validity, and generalizability of the research findings, and present an integrated synthesis of the research that sheds new light on the topics within and across the four domains.  The result of a successful integrative literature review may be a significant contribution to a particular body of knowledge and, consequently, to research and practice. Therefore, before writing this literature review, substantive new research must be conducted via the Internet and within the Ashford University Library for each of the four chosen domains.

A minimum of six sources must be included for each of the four domains. Although content from literature reviews completed in prior courses within this program may be included, it may not constitute the total research for the individual domains addressed within this assignment. No more than four sources from previous literature reviews completed in this program may be utilized for this integrative review.  The headings listed below must be used within the paper to delineate the sections of content. Therefore, it is of pivotal importance to understand the basic tenets of critical appraisal of research for its use in intraprofessional healthcare practices. The aim of evidence-based practice (EBP) is to employ a three-pronged approach blending the best available research evidence, patient values and preferences, and clinical expertise.

In this task, you will critique two primary research evidence sources. You will select one quantitative and one qualitative peer-reviewed journal article on a healthcare topic of interest.

Requirements:

Your submission must be your original work. No more than a combined total of 30% of the submission and no more than a 10% match to any one individual source can be directly quoted or closely paraphrased from sources, even if cited correctly. Use the Turnitin Originality Report available in Taskstream as a guide for this measure of originality.

You have three options in how you can present your final project:

As a Paper

Your paper should be creative and demonstrate what you have learned. It should be a minimum of 5-7 pages in length and you will use APA style formatting with a title page and reference section. You should use Times New Roman, 12pt. font, double-space your lines, and set your page up with one inch margins. See the APA templates at Writing Commons for details on how to format your paper.

As a Presentation

Like the paper option, your presentation should be creative and demonstrate what you have learned throughout the project. Your presentation should be 8-10 minutes in length, include visual elements (graphics, pictures, etc.), be presented using a program such as PowerPoint or Prezi, and you should record yourself giving the presentation. Consider using screen capture programs such as JING or Screencast-O-Matic.

As a Speech

As it is in the other two options, your speech should be creative and demonstrate what you have learned throughout the project. Your speech should be 8 to 10 minutes in length and include a typed handout.

The Community Organization: Clearly indicate the focus of the organization and the community needs that the organization wants to address. A brief historical background of the organization should also be included.

  • Discuss any community partnerships that they have. Suggest additional partnerships that you feel they should have.
  • Explore how the cross-cultural challenges and humanitarian considerations are involved.
  • Demonstrate how the organization uses volunteers and the economic benefits associated with this (not just “free labor”).

Continuous quality improvement (CQI) is taken very serious at my organization, as I am sure it is taken serious at my fellow classmates facilities. CQI is a quality management process that encourages the health care team members to continuous ask “how are we doing” and “can we get better” (Moran, 2012). CQI is for the safety and education of the patients and staff members. We report out each morning about 30-day readmissions in house or patients at high risk for a 30-day readmit. We have a team that identifies the trends of the readmission predictors in order to identified patients currently in house at high risk for 30-day readmission. After the identification of the high risk patients, a structured discharge plan is put in place. Education on the disease process and discharge instructions is immediately started with the patient and care givers. Outside resources are immediately identified, such as home health and hospice, and the patient is given the patient choice form to pick the company that they would like to use on discharge. On discharge, the patient will know their disease process and how to manage at home. The patient will state what medications they are taking and what they are taking them for.
The patient will also state what time of day the medication is due. The patient will receive a phone call within forty eight hours after discharge from the hospital to make sure the patient continues to understand all discharge instructions and medications.

Continuous quality improvement, CQI, is a viewpoint or attitude for evaluating processes and improving them to attain customer satisfaction (Huber, 2014). CQI focus in healthcare is usually related to improving patient outcomes (Conner, 2014).

There is no delaying that hospitals need to deal a brand in today’s medical world. I can speak for the organization where our brand is high-quality care at low cost. A part of growing a brand that delivers high-quality care consistently it is vital to continue to maintain an emphasis/focus on identified quality improvement initiatives. To create a hospital culture supportive of quality improvement, respondents stressed the importance of hospital leadership being in the vanguard to engage nurses and other staff. As a representative of an accrediting organization said, “For any quality improvement project to be successful, the literature shows that support has to trickle down from the top (Draper, Felland, Liebhaber, & Melichar, 2008).

The chief nursing officer, CNO, is passionate about the delivery of high-quality care, she talks about it each month at nursing leadership, and it is a constant in my staff meeting minutes. It is vital that we empower the nurses who are delivering the care at the front line to buy into initiatives. We have encouraged staff to participate in hospital-wide performance improvement and report out our progress as a healthcare system in unit councils.

One example of how we are applying CQI in our current practice is through our CAUTI initiative. We have developed an education package for the staff which was accompanied by a nurse-driven protocol for patients that have a foley. If we have a patient who comes through the emergency department, they need to meet specific criteria before a foley can be inserted. We have seen great successes in this project, and the results have been extremely positive.

Introduction

People with disabilities have always been faced with problems that in most cases are associated with the perception of the members of the community. In most cases, they are people who cannot bring up healthy children. At the same time, they are perceived as people who do not have what it takes to be equal members of the society. However, the level of disability ought to be a consideration. Some of the people with disabilities have all it takes to raise their children and therefore they should not be denied the opportunity to do so. However, there is also a need to support them for the sake of making sure that their children are provided with all the resources they need to be as active as the children of healthy parents.

There is a vast difference between what was happening ten years ago and what is happening now. In the modern day, the law and the members of the society have realized that disability is not inability. As a result, the law and the members of the society are trying to support the disabled rather than take away what they already have. Instead of taking away their children, measures to support them are put in place with the intention of making them enjoy parenthood and feel as part and parcel of the society (Cuskelly & Bryde, 2004).

How far we have come

The people with disabilities have been embraced more than ever. The private sector and the public sector are working together to make sure that people with disabilities are empowered. The steps include presenting the opportunities of employment, encouraging the disabled to be educated, nurturing their talents because some of them might not be good when it comes to academics, and making sure that they have access to the resources that are likely to make their lives better (Olsson & Hwang, 2001).

Significant strides have been made towards embracing the members of the society who have exceptionalities. However, more is yet to be done. It is imperative to remember that people with disabilities do not choose to be in their situations and at the same time they will continue to be born (McConnell & Llewellyn, 2002). Therefore, there ought to be ways in which the environment is changed to be friendlier and more accommodating. Some sections still see the disabled persons as a burden to the society, and therefore they deny those opportunities to better themselves. In this respect, there is a need to create awareness and make sure that the members of the society do not add pain to the lives of the disabled.

The case of Susan is an excellent example of the extent that the disabled people are willing to go for the sake of their loved one. Susan went back to school to fit to be a parent to her daughter. The action is an indication that there is a need to empower the disabled in the society (Cuskelly & Bryde, 2004). Most are the times when the disabled are seen as people who cannot be of help to the society, and therefore nothing is done to better their lives. Empowering them will make them more independent and contributors to the growth and developments of the nation.

How laws influence these decisions

Americans with Disabilities Act and IDEA(Evolution of Disability Parenting Rights)

Americans with Disabilities Act is a legislation that looks after the well-being of the people who are mentally impaired. The Act makes sure that the people who are disabled are not discriminated because of their conditions. At the same time, the Act approves the registration of people who are disabled with the intention of making sure that they are recognized and supported in different ways (American Psychological Association, 2018). The law influences the decisions that are made whether in the court of law or real-life scenarios because they are in place to be followed.

Ethical principles that might apply to the situations

American Psychological Association

The ethical principle that applies in this situation is section three which talks about Human Relations. Chapter 3.01 focuses on Unfair Discrimination. The chapter prohibits discrimination based on gender, age, socioeconomic status, sexual orientation, race, identity, disability, and any other aspect that makes people different ways (American Psychological Association, 2018). Therefore, it is apparent that people with disabilities ought to be treated as healthy members of the society in every way.

American Counseling Association 

The ethical principle that applies to this case is Forced Family Separation at U.S. Borders: Resources on Childhood, Family Trauma American (Counseling Association, 2014). The case that is at hand has touched on potential family separation, and therefore the ethical principle fits in perfectly. At one point or another, there have been interventions that have tried to protect the forced family separation in the two cases that have been focused on.

Arguments for and against

A parent with a disability should be given the right to raise a child. The mental state of a person is known in the first nine months of pregnancy. Where some may think that sustaining a pregnancy is an easy task, it is one of the hardest tasks that face the parents (Olsson & Hwang, 2001). If a parent can protect a child for nine months, it is only fair to let the parent enjoy the fruits of her labor. At the same time, it is imperative to note that a child has the right to be with his or her mother.

Despite the condition of a mother, there is a bond that is established between a mother and a child. This is one of the reasons why some of the children who are brought up by foster parents end up looking for their parents after they have grown up (Olsson & Hwang, 2001). The love that a mother offers to a child is immeasurable and cannot be offered by any other person. It is for this reason that there is a need to make sure that a parent is given the right to care for her child.

The life of a child should be taken with the seriousness it deserves. It is imperative to note that the experiences of a child in the current day will come to haunt the child in future. In this respect, it is essential to make sure that a child is cared for by a person who can do so (McConnell & Llewellyn, 2002). Taking a child away from a disabled parent is not punishing the parent as many see it. A disabled parent faces the challenges of taking care of her life, and this means that adding a child to her life would be stressing the parent more. Considering that this is a person who might not be in the best position to deal with stress, it would be essential to avoid the stress. A stressed disabled person might not give a child the best care that is needed to shape the child into an essential member of the society.

Love from a parent is not all that a child needs to grow. The support of a parent in different areas is also essential for the growth of the child. For example, a child who is normal needs to be with normal parents so that they can guide the child through his or her stages of growth (Cuskelly & Bryde, 2004). With the lack of parents who can support him or her, a child is exposed to the risks of failing to fit in with the other children of his or her age. In this respect, there is a need to make sure that the child is cared for by people who are mentally able.

The family 

The family members play a significant role when it comes to the success. The video has exposed the audience to a scenario where the family members are involved in the lives of their disabled relatives (Olsson & Hwang, 2001). The family members should not allow the issue of custody to get to courts. It would be better for them to take the responsibility to support the parents. By doing so, the child receives care from the mother, and family members and the mother gets to watch her child grow.

Within the community

One of the reasons why the children of the disabled feel worse about their parents is because of the attitude that most members of the community have developed towards the people with disabilities. There is a dire need to change the perception and attitude of the members of the society towards the disabled. Awareness would come in handy to educate the members of the society that the disabled persons are also human beings and there is no need to look down on them (McConnell & Llewellyn, 2002). By doing so, the members of the society will be able to offer support to the families and the children. When the child lives in an environment where all members of the community are taking care of him or her, challenges of homework assistance and support from parental figures would be a thing of the past.

The school

The school has a role to play when it comes to taking care of the children of the disabled parents. There is a need to support the child by providing more attention to the child because the parents might not be in the position to help the child (Cuskelly & Bryde, 2004). It is paramount for the teachers to know the type of students they teach and to offer extra help when it is needed. At the same time, the counselors at the school should be dedicated to changing the lives of the students who have disabled parents. Continuous follow-ups are essential in this case.

Generalization of the issue to other exceptionalities(Evolution of Disability Parenting Rights)

The challenges that people with intellectual disabilities face are almost like those other people with different disabilities face. For example, a person with a physical disability is likely to be mentally fit, but it might be a challenge for him or her to implement his or her idea. However, he or she is in a better position because with technology things can be made better as opposed to a person with an intellectual disability. Cases of people with physical disabilities losing the custody of their children are less, and this is because what matters more is the state of mind. When a person is mentally able to support his or her family, other issues are secondary (Olsson & Hwang, 2001). With the current evolving world, many employment opportunities do not need one to leave the house. Such opportunities only need the skills of using a computer. Therefore, the challenges that are faced by people with other exceptionalities are not as severe as those faced by people with intellectual disabilities.

A review of current thinking for and against people with exceptionalities raising children

Based on the sources, it is apparent that parents with intellectual disabilities have what it takes to raise their children. A good example is seen in the case of Susan. Susan proves that she can be a good mother by taking steps which transform her into a better parent than people could ever think (Cuskelly & Bryde, 2004). The case of Susan is however challenging because of her past which was affected by sexual harassment. Therefore, it is evident that if she was brought up in a peaceful environment, she might have turned out to be a better person despite her disability. It is essential to give people with disabilities a chance to be parents to their children.

A child should be supported by people who can provide him or her with all he or she needs to grow and develop. It is for this reason that it is not fit for people with disabilities to raise their children (McConnell & Llewellyn, 2002). However, there is the need for an external intervention of a person or people who are mentally stable. A good example is seen in the case of Mary Ann. The presence of her aunt changes her life for good, and that means that there is a need to have people who are mentally stable to help in raising the child.
