Purpose

This week we will continue exploring and discussing the foundations of psychological ethics. This material will assist in examining specific ethical behaviors in upcoming weeks. A key focus for this session is knowing what you need to know to practice within bounds. This includes various standards, rules, and ethical principles.

Objectives

1. Become familiar with the resources available online from your state or provincial licensing board and the role of the APA ethics code in those resources.

2. Gain a global familiarity with the Ethical Principles and Standards of the American Psychological Association.

 

Knowledge is key. If you are not familiar with your state practice act (and perhaps the notion of Sunset legislation), the rules and regulations of the licensing board in your state, the applicable code of ethics (the APA code of Ethics is for APA members, it may or may not be part of the expectations of your licensing body), what the reporting laws are for mandated exceptions to confidentiality (child/elder abuse), what the laws are related to family disputes -particularly child custody, what the laws are related to sexual exploitation, and whether such major issues as duty to warn apply, then you are vulnerable to making a mistake because you did not know. The law takes a dim view of not knowing the rules when you are part of a professional body. You need to learn those things that directly affect you.

If you get sued for warning someone they are at risk based on a therapeutic communication, it can be proper in both directions. Your client had the reasonable assumption of privilege if that is what the state rules are, or what you told him, and you may be answering a higher call in warning someone they are at risk, but you still can get sued.

Complaints against psychologists are (more or less according to the jurisdiction occurring in the following order). 1) Sexual intimacies with clients; 2) negligence (failure to warn, improper supervision); 3) fraudulent practices (lying about work performed, diagnosis, price fixing, etc.). 4)criminal conduct; 5) impairment; and, 6) breach of confidentiality.

Research and Define the Problem
You must take on the perspective of your major field of study and explain in your paper what that perspective is and how it informs your view of the topic. The topics listed above are far too broad to write about in 10–12 pages (3,300–3,900 words). Instead, you must choose a narrowly defined thesis and approach it from the perspective of your field.

Example: If you are an economics major, and you are interested in immigration reform, you should approach a very specific aspect of immigration reform through the lens of economic theory and practice. A specific thesis question would not be, “How does illegal immigration influence the U.S. economy?” One could write thousands of pages on such a topic. Instead, a better question would be, “How do illegal immigrant hotel workers in Chicago impact the economy of Northern Illinois?” You would then want to do the research and determine the positive and negative impacts they have, ultimately trying to conclude how illegal immigration in this area should be approached ethically.

How to Hone Your Thesis: It is important that you start your research early in this course. Try to find the most important contemporary questions and theories in your field of study and then align the most important questions with a very specific aspect of the general topics above. For example, if you are a psychology major, you might want to start thinking within the realm of healthcare reform or aspects of mental health and criminality in the prison system (GEN499: General Education Capstone (Solved)).

For example, going back to the example issue above, from an economic standpoint, illegal immigrants might contribute positively to the economy of Northern Illinois in a specific number of ways. Thus, an economist who believes that positive impact to the economy is the greatest good would say that one should promote the use of illegal immigrants. However, because these workers are often paid less than others and eliminate jobs that could be done by residents of Chicago, there could be other negative ethical outcomes that would outweigh the positive impacts to the economy. It is your goal to draw out the ethical implications of your thesis and explain the underlying rationale that is the foundation for your claim that one action is better than another.

  • Critical thinkers are those who can outline the positive and negative ethical impacts of their positions. In addition, they are able to provide a rationale for why they believe a specific position is the right position, even when it leads to negative outcomes.
  • Critical thinkers are also able to be honest and objective about the limitations and gray areas that pertain to their theses.

Last month you were hired with the title Chief Health Informatics Specialist at an independent community care hospital with 350 beds. The hospital has a working relationship with a major academic medical center located 23 miles aay. Acute care patients who need more extensive treatment are usually transferred to the medical center. While the nursing home has its own medical staff consisting of a physician and two nurse practitioners, patients needing consults or additional care are usually seen at the hospital with follow-up at physician’s offices. While the nursing home, most of the physicians’ offices, and the hospital are independent institutions there is a long history of sharing health relate data when treating patients who live at the nursing home and are seen at the hospital or in the physicians’ offices. This coordination has been a general benefit for a number of patients. It appears that most patients have signed a form giving the hospital permission to send information to the nursing homes. However, these forms have been stored in individual offices so it is difficult to determine who has signed what forms and what permission has or has not been given to share information between the nursing home, hospital and independent medical practices.
